Refunds and Returns Policy

At Whisky Estate, we take great care to ensure every bottle reaches you in the condition in which it was listed.

1. Change of Mind

We do not accept returns or offer refunds for change of mind under any circumstances. Once a bottle has left our storage facility, we no longer have control over its handling or storage, and we strongly advise customers to obtain insurance for their purchase.

2. Faulty or Damaged Products

If a bottle arrives faulty or damaged, we will work with you to arrange a suitable remedy, which may include a repair, exchange, or refund, subject to the following:

  • The claim must be lodged within 7 days of delivery.
  • The item must be returned to us in its original condition, with all labels, tags, and packaging intact, for assessment before a remedy is issued.

This clause does not apply to consignment items β€” see Section 5.

3. Incorrect or Not-as-Ordered Items

In accordance with the Australian Consumer Law (ACL), we will accept returns where a bottle arrives incorrect or not as ordered (i.e. where the error was ours), provided:

  • The claim is lodged within 7 days of delivery; and
  • Your claim includes your name, delivery date, and order or transaction number.

4. Customer Ordering Errors and Cancellations

If you order a bottle and, upon receiving it, realise you selected the wrong item, we are under no obligation to accept an exchange. However, at our sole discretion, we may agree to an exchange, with additional freight and handling costs applying.

If you wish to cancel an order that has already been shipped, you may do so, but you will be responsible for the cost of returning the item to us, along with any transaction fees charged. Late delivery, for any reason, does not entitle you to cancel your order.

5. Consignment Products

Consignment items are sold on behalf of private collectors and are not covered by our standard refund or exchange remedies. No refund or exchange will be offered on consignment products, including in cases of change of mind or ordering error. This does not limit any rights available under the Australian Consumer Law in respect of major faults or misrepresentation.

6. Undeliverable and Returned Parcels

If a parcel is returned to us by Australia Post due to an incorrect address, non-collection, or delivery refusal, a $45 return fee will be deducted from any refund amount, or charged prior to re-dispatch.

7. Proof of Return

Before any refund, store credit, or exchange is processed, Whisky Estate requires evidence that the parcel has been returned to, or intercepted by, our courier partner. Acceptable evidence includes a tracking link, courier receipt, or other written confirmation of return.

8. Processing Time

Refunds and exchanges will be processed within fourteen (14) days of receiving the returned goods.

9. Discretionary Refunds

Where Whisky Estate, at its sole discretion, agrees to issue a refund outside of the circumstances described above, the refund will be issued less a refund fee of $10, as well as any applicable transaction fees. This discretionary fee does not apply to change of mind, as no refunds are issued for change of mind under any circumstances (see Section 1).

10. Pricing and Listing Errors

While we make every effort to keep our website content current and accurate, occasional errors may occur, including incorrect pricing, descriptions, or offers relating to products that are unavailable or no longer available. To the extent legally permitted, we may decline or cancel any order affected by such an error, even where the order has been confirmed and payment charged. Where this occurs, we will notify you and credit your original payment method for the amount charged.

11. Condition of Consigned and Collectible Items

Some products offered for sale originate from private collections. In these instances, all images displayed are of the exact bottle being sold and are intended to accurately represent its condition at the time of listing. Due to the nature of collectible and consigned goods, minor imperfections may be present, including but not limited to label wear, packaging marks, or seal variations.

Customers are responsible for reviewing all product images carefully prior to purchase. Items are sold on an "as is" basis, and the condition visible in the images forms an essential part of the product description. By completing a purchase, the buyer acknowledges and accepts the bottle's condition as displayed. If additional images or information are required to assess a bottle's condition, please contact us at info@whisky.estate prior to purchasing.

To the extent permitted by law, no claims will be accepted in relation to cosmetic condition, packaging wear, or presentation where such details are clearly visible in the product images. This does not limit any rights or remedies available under the Australian Consumer Law in respect of major faults or misrepresentation.

12. Your Rights Under Australian Consumer Law

Nothing in this policy limits your rights under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure, and compensation for other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
